If you have made a purchase from us we may occasionally update you on our latest products, news and special offers via e-mail, post & telephone. All our Xazha Ltd customers have the option to opt-out of receiving marketing communications from us. If you do not wish to continue to receive marketing from us you should opt-out by visiting your account details page or by our contact us page and letting us know. You might be contacted once by Trusted Shops which is an independent reviews company.
 

TERMS OF SALE

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please contact us via the contact us page for overseas delivery charges. In order to contract with Xazha Ltd you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Xazha Ltd retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

(A) OUR CONTRACT

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. If we are informed that an order is a gift then the orders will not include any documents that would reflect the price only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

(B) PRICING AND AVAILABILITY

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If we cancel and you have already paid for the goods, you will receive a full refund. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

(C) PAYMENT

We use Paypal and HSBC (Global Payments) to process your payments. These are both secure payment platforms and will do authorization checks to valid our transaction. We are also compliant with PCI DSS requirements. Upon receiving your phone order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

(D) DISCOUNT CODES

(i) Account discount codes - Discount codes may from time to time be offered; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered. (ii) Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website. The conditions of use relating to any discount code will be specified at the time of issue.

(E) DELIVERY

We aim to send out your product within 24 hours of receiving your order. Please notify us of any claim or issues with non-delivery via our contact us page. We use Royal Mail, First Class. Of course Xazha Ltd cannot be held responsible for any issues with the postal service, including industrial action. Royal Mail aims to fulfill delivery times of 1-3 days for the UK, 2-5 days for Mainland Europe and 3-14 days elsewhere in the world. Should you require an alternative postal services, please contact us with details and the prevailing rate will be charged.

This includes possible strike action and lost items. No claims for lost items can be made prior to 21 days from the date of sending.

(F) RETURNS

In the event you are not entirely satisfied with your purchase, you can choose to exchange for either an alternative item or receive a refund less the cost of shipping and gift boxes. Goods need to be returned within 14 days from receipt and should include a completed returns note. A returns note will be emailed to you on request.

Please ensure that returned goods are in perfect condition, as we cannot accept products back, which have been used. They need to be returned in their original polythene bag. Items contaminated with perfume, makeup or cigarette smoke will not be accepted for refund, credit or exchange.

We will not be held responsible for items lost in the post when being returned. We advise that you request proof of postage at your post office as claims cannot be processed without this. Buyers are responsible for any returns postage cost.

Should you select a more expensive item for the exchange, please include a cheque for the difference. Or arrange for with us for payment to be made. PACKAGING

Packaging is of a very high standard and all care is taken to ensure that all your goods arrive in top condition. If you have selected a gift wrap we will assume that all items are a gift and wrap them together.

FABRIC COLOUR RANGE

Please note that all the colours shown give the most accurate shade indication possible, but no computer can faithfully reproduce the exact shade.

CARE

For Silk that can be washed: - For best results, hand wash your items in a mild or specialist silk detergent. Dry naturally - silk dries very quickly - do not tumble dry. You can iron on the low/silk setting. We cannot be held responsible for any damage caused during washing. Silk is incredibly resilient and repels dirt and mildew, so it should last many years if looked after. For Silk that can only be dry cleaned: - Please take these to a dry cleaning specialist. Cottons: - These can be washed on a 30degree cycle. Please take care if you need to iron the items. Iron on a low/medium setting and do not stretch while ironing.

COMPLAINTS

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments via our contact us page in the first instance, providing your contact details.

INTELLECTUAL PROPERTY AND CONTENT

The intellectual property rights in all content made available to you on or through this Website remain the property of Xazha Ltd and are protected by copyright laws. All such rights are reserved by Xazha Ltd. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

You shall not modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on any product or accompanying documentation supplied by Xazha Ltd. Trade marks are being applied for and of course the use of the business name Xazha Ltd and copying of the unique properties of the product and logo usage is prohibited. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are colourable similar without the written permission of Xazha Ltd.

LINKING TO THIS WEBSITE

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Competition terms and conditions

The following rules are applicable to all competitions, promotions, games, votes, offers or other similar commercial offering (referred to herein as 'competition') conducted by or on behalf of Xazha Ltd until further notice or until amended.

These rules will be deemed incorporated in each competition except to the extent that any specific instruction in a competition (hereafter called the 'competition instructions') provides otherwise, in which case the competition instructions shall take precedence.

By entering the competition, entrants (or voters for a particular entrant) together with any other member of the public involved (all such persons being referred to as 'entrant') hereby agree to be bound by these rules as amended from time to time, and by any competition instructions.

It is the responsibility of entrants to keep themselves informed as to any updates of these rules, and they acknowledge that any failure to comply with these rules could lead to their disqualification without reasons being given or opportunity for challenge.

1. The Judges shall, unless provided otherwise in the competition instructions, be the Director for the time being of Xazha Ltd and/or his nominated representative(s), and "Judges" herein shall mean such person or persons. The identity of the Judges may be requested by sending a stamped addressed envelope to Xazha Ltd, 8 Lyndhurst Road, Rugby, Warwickshire, CV214HL.

2.1 The general principle is fairness: entries or votes should be made or cast fairly. If, in the opinion of the Judges this principle has been flouted, they can declare any entries or votes invalid, void the competition, change the competition instructions, or adjust the entries or the voting to achieve fairness, as they think fit. The competition instructions may carry a specific indication, but in the absence of such an indication, only one entry/ vote per entrant (or household, computer or other unit as appropriate) will be permitted.

2.2 The decision of the Judges over every instance shall be final and unchallengable and in their absolute discretion they may declare void any entry/ vote or the competition itself should they consider that there are no entries reaching a required standard, whereupon they can award prizes or not as they think fit. Judges shall have the right, at their discretion, to change the rules of a competition while it is running if it appears to them that it would be equitable or appropriate to do so, including the extension of the closing date whereupon there will be an announcement of any such extension at the first reasonable opportunity. No correspondence will be entered into or comment issued on any matters concerning any competition, and no reasons given for any decision made by the Judges.

3. All competitions are open to UK residents aged 18 or over unless any other age restriction is specified or implied. Where entrants are required to enter in one of several age categories, the applicable category shall be that appropriate to their age on the closing date of the competition. Entrants should, if under 18, obtain permission in advance from their parent or guardian and be able to demonstrate that to the Judges's satisfaction. Employees of Xazha Ltd, regular contributors and contractors, the promoters and individuals connected with any company involved in the competition, agents and members of the immediate family of the above people will not be eligible to participate.

4.1 All entries must be legible, written in ink or ballpoint pen, and made on the official form, if there is one, or the official page on the website (www.xazha.co.uk or any other website associated with Xazha Ltd as appropriate). They must be clearly marked with the entrant's name, address, email address and telephone number as requested. Any illegible, mutilated, altered, corrupted or multiple entry may be disqualified.

4.2 Entries must be made in accordance with the competition instructions. They are invalid if they are received any later than the specified closing time (which shall be London date and time).

4.3 In the case of token collect or voucher promotions, only originals are valid. No tokens or vouchers are redeemable for cash. 

4.4 All questions must be answered and all other entry requirements fulfilled, including in any ‘pay to enter’ competition each entry must be accompanied by the appropriate entry fee or proof of purchase as appropriate.

4.5 Proof of submission or of posting of a form will not constitute proof of delivery and no responsibility will be accepted for lost, corrupted, delayed or mislaid entries.

4.6 The winner will be chosen in accordance with the competition instructions and the exercise of their residual discretion by the Judges, and either will be the first correct entry drawn from the total entries or all entries will be examined and the prize awarded to the entry that the Judges consider to be the best.

4.7 Other prizes will be awarded in accordance with the order of priority as stated in the individual competition.

5. Xazha Ltd reserve the right to publish the names of the winners and runners-up, and the winning entries themselves, and all winners are required to give their full co-operation to all requests by Xazha Ltd or a promoter in connection with publicity for the competition, their entry, the prize or otherwise.

6. Xazha Ltd shall have the following rights over all winning entries:- the exclusive, irrevocable, worldwide licence to first publication; and a non-exclusive licence to publish, syndicate, distribute, reproduce and exploit the material in all present and future media and formats and to sub-license these rights to others. Entries, however submitted, will not be returned by Xazha Ltd.

7. There will be no cash or other alternative to the prize offered and prizes are not transferable.

8. Where applicable, prize winners will be responsible for organising valid passport(s) and for securing any necessary visas or complying with other regulation. They are also strongly advised to take out adequate insurance and health advice. Dates, destinations and other specific details of a prize are subject to availability.

9.1 Xazha Ltd will not be liable for any circumstances beyond its reasonable control that prevent the competition being fulfilled, a winner or winners being chosen, or any prize being taken up or fully enjoyed by a winner. Xazha Ltd excludes liability to the extent permitted by law for any cost, claims or losses howsoever caused that arise by reason of any person's entry into a competition or the award, or non award, to them of a prize. In the event of any error, whether printing, technological or otherwise, which affects the competition in any way, the Judges reserve the right to administer the competition as though the error had not occurred.

9.2 If any winner of a competition is unable to take up a prize for any reason, or if Xazha Ltd has not been able, after making reasonable efforts, to make contact with the winner, Xazha Ltd reserve the right to award that prize (without notice to the first winner chosen) to an alternative winner, in which case the first winner chosen shall not be eligible for any share of the prize whatsoever. Xazha Ltd shall not have any liability in such eventuality.

10. Where necessary in order to determine an outright winner or winners in a competition, the Judges reserve the right to require that entrants take part in an eliminating contest (or 'tie breaker'). If for any reason there are more winners than prizes, whether or not that has arisen as an unforeseen eventuality or is part of the competition structure, the Judges reserve the right to conduct a draw to determine the winner or winners of the prizes.

11. Entrants may be asked to indicate their wish, by ticking or checking a box provided in the competition instructions or otherwise, to receive or decline to receive communications with information or carefully selected commercial opportunities from Xazha Ltd or agents on their behalf. Xazha Ltd will hold any personal details it is entitled to hold on its own or a duly authorised agent's registered database for the purposes of optimising its editorial and commercial offering to readers and website users, actual or potential.
